Terms and conditions

Version 2026-09-20. By voting you accept these terms. Read them: there is money involved.

1. What Top&Flop is

A public game with one single ranking, from best (first place) to worst (last place). The first 10 form the TOP and the last 10 the FLOP. Anyone can pay to lift an item or sink it, wherever it stands. It is an entertainment service for subjective opinions. There are no prizes, draws, bets or chance.

2. How votes work

• Every euro is one vote. Amounts are whole euros, from €1, with no upper limit of our own (payment providers may apply theirs) per transaction.
• A vote weighs what was paid: paying €10 counts ten times more than paying €1.
• Each vote adds (lift) or subtracts (sink) from the item's score: score = euros for − euros against. Position is set by the score. Ties go to whoever reached that total first.
• An item can receive votes for and against: both amounts are recorded and shown separately, but the position depends on the difference.
• There are "all-time" and "today" rankings (calendar day, Spain time). A payment counts on all of them.
• Position is computed when payment is confirmed. Someone may overtake you instantly; no position or duration is guaranteed.

3. Who can vote

Natural or legal persons with legal capacity, aged 18 or over, using a payment method they are entitled to use, and providing a valid email.

4. What can be voted on

Only commercial products, brands and models in the catalogue (e.g. a car model). Not natural persons or personal data. Suggested new items are moderated before publication.

5. Price, taxes and payment

Prices are shown in euros and, where applicable, include applicable taxes: VAT included. Payment is made through third-party providers (Stripe, PayPal and Dodo Payments) on their own secure pages; Top&Flop never receives or stores your card details. When a payment is processed through Dodo Payments, it may act as merchant of record for that transaction and appear on your statement; its terms apply to that transaction. Your bank or the provider may charge fees or currency conversion.

6. Immediate performance and withdrawal

A vote is a service performed immediately: once payment is confirmed your vote is recorded and publicly changes the ranking. Before paying you must expressly tick that:

• you request the service to start immediately, and
• you acknowledge that, once fully performed, you lose your right of withdrawal (article 103(a) of Spanish Royal Legislative Decree 1/2007, and article 16(a) of Directive 2011/83/EU).

Without ticking that box you cannot complete payment.

7. Refunds

Votes are non-refundable, including if an item is later overtaken, you change your mind, it drops from the "today" ranking at midnight, or the item is removed for breaking these rules. We refund only where the law requires it or in cases of duplicate charge, wrong amount or unauthorised payment reported to gestion@topandflop.com with the order ID. A refunded vote stops counting.

8. Chargebacks and fraud

If a chargeback or dispute occurs, the vote stops counting and we may block the payer. Using stolen or third-party payment methods is prohibited. We retain the data needed to defend ourselves and cooperate with authorities.

9. Alias and comments

When voting you may add an alias and a short comment. You alone are responsible for it. It is moderated before publication and removed if unlawful, defamatory, discriminatory, misleading, promotional, containing personal data, or infringing third-party rights. You grant us a non-exclusive, free, worldwide licence to display it while published. You may request removal at gestion@topandflop.com.

10. Subjective nature of the rankings

Rankings do not measure quality, safety, reliability or value of any product. They reflect what other users paid. They are subjective opinion and entertainment content, not statements of fact or recommendations. See the Notice on opinions and rankings. Anyone, including manufacturers or competitors, may pay to raise or sink an item; we do not verify identity or motives.

11. Third-party trademarks

Brands and models are used only to identify products, as permitted by trademark law. There is no affiliation, sponsorship or endorsement. Owners can use the notice and takedown procedure.

12. Prohibited conduct

Manipulating the system with automation, exploiting bugs, fraudulent payment methods, mass data extraction, attacking site security, impersonation or publishing unlawful content. We may block access, remove content and cancel votes that breach these rules.

13. Availability and changes

We may suspend the service for maintenance or technical reasons and change these terms; the current version is shown at the top and applies to votes after publication. If the service ends permanently we will give reasonable notice.

14. Liability

We are liable as the law establishes. We are not liable for indirect damages, for an item losing position, or for decisions you take based on the rankings. This does not affect consumers' non-waivable rights.

15. Law and complaints

Spanish law. EU consumers keep the mandatory rights of their country of residence. You may complain at gestion@topandflop.com; we will try to resolve any issue in good faith.
